These Terms of Use govern your access to and use of FAVORO, a bookmark management service operated by andworks GmbH.

By creating an account or using our service, you agree to these terms. If you do not agree, please do not use FAVORO.

1. Service Description

FAVORO is a bookmark management service that allows you to:

  • Organize bookmarks into areas and sections
  • Access your bookmarks from any browser
  • Use a customizable start page for quick access to your favorite websites

The service is provided as Software-as-a-Service (SaaS) and is accessed through your web browser.

2. User Account

2.1 Account Creation

To use FAVORO, you must create an account using a valid email address. You are responsible for:

  • Providing accurate account information
  • Keeping your login credentials secure
  • All activities that occur under your account

2.2 Passwordless Authentication

We use one-time codes sent to your email for authentication. You must have access to your registered email address to log in.

2.3 Account Security

You must notify us immediately if you become aware of any unauthorized use of your account.

2.4 Age Requirement

You must be at least 16 years old to use FAVORO. By creating an account, you represent that you meet this age requirement.

3. Right to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use FAVORO for your personal or business bookmark management needs.

This right does not include:

  • The right to resell or redistribute the service
  • The right to modify or create derivative works
  • The right to use the service for any unlawful purpose

4. Your Content

4.1 Ownership

You retain ownership of all bookmark data you store in FAVORO, including:

  • Area names and organization
  • Section titles
  • Link labels and URLs

4.2 License

By using FAVORO, you grant us the limited right to store, process, and display your bookmark data solely for the purpose of providing the service to you.

4.3 Data Export

You can export your bookmark data at any time through the settings page.

4.4 Responsibility for Content

You are solely responsible for:

  • The legality of the websites you bookmark
  • Ensuring you have the right to store and access the linked content
  • Any consequences arising from accessing websites through your bookmarks

We do not monitor, review, or verify the content of websites you bookmark. You acknowledge that FAVORO is merely a tool for organizing links and does not host or control third-party content.

5. Acceptable Use Policy

5.1 Permitted Use

You may use FAVORO to store, organize, and access bookmarks to websites for personal or professional purposes, provided such websites contain lawful content.

5.2 Prohibited Content

You agree not to use FAVORO to store links to any websites that:

  • Contain, distribute, or promote illegal content under applicable law
  • Infringe upon intellectual property rights of third parties
  • Contain malware, viruses, or other harmful software
  • Promote violence, hatred, discrimination, or illegal activities
  • Are designed to deceive users or steal personal information (phishing)
  • Violate the rights of others, including privacy rights

5.3 Enforcement

We reserve the right to remove any bookmarks or suspend/terminate any account that we reasonably believe violates this Acceptable Use Policy, without prior notice and without liability to you.

6. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key points:

  • We only collect data necessary to provide the service
  • We do not sell your data to third parties
  • We use privacy-focused analytics (Fathom)
  • You can delete your account and data at any time

7. Service Availability and SLA

7.1 Availability Target

We strive to maintain 99.5% monthly uptime for the FAVORO service. This target excludes:

  • Scheduled maintenance windows (announced at least 24 hours in advance where possible)
  • Force majeure events beyond our reasonable control
  • Issues caused by third-party services or internet connectivity

7.2 Data Protection

  • Backups: We perform automated backups twice daily
  • Retention: Backups are retained according to our backup policy (7 days full retention, then daily/weekly/monthly)
  • Recovery: In case of data loss, we will make reasonable efforts to restore from the most recent backup

7.3 No Guarantee

While we target high availability, we do not guarantee uninterrupted access to FAVORO. The service is provided on an "as-is" basis.

7.4 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects service availability. Where possible, we will provide advance notice.

7.5 Changes to Service

We may modify, update, or discontinue features of the service at any time. Significant changes will be communicated in advance where possible.

8. Subscription and Fees

8.1 Subscription Plans

FAVORO offers subscription-based access to the service. Available plans and their features are described on our pricing page. We may offer free trials or promotional pricing from time to time.

8.2 Subscription Period

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

8.3 Price Changes

We reserve the right to adjust subscription fees to reflect changes in market conditions, infrastructure costs, extended functionality, or other improvements to FAVORO. We will notify you of any price changes at least 30 days in advance. Price changes will take effect at the start of your next billing period.

8.4 Free Plan Limitations

If FAVORO offers a free tier, we reserve the right to modify or discontinue the free tier at any time with reasonable notice.

9. Payment Terms

9.1 Payment Provider

All payments for FAVORO subscriptions are processed through Paddle.com (Paddle.com Market Limited), which acts as the Merchant of Record for all orders. When you make a purchase, you may be redirected to Paddle's payment platform, and the transaction will be subject to Paddle's terms and conditions in addition to these Terms of Use.

9.2 Advance Payment

Subscription fees must be paid in advance. Your payment method will be charged at the beginning of each billing period.

9.3 Payment Methods

We accept various payment methods through Paddle, including major credit cards and other payment options available in your region. Paddle handles all payment processing, currency conversion, and tax calculations.

9.4 Invoices and Receipts

Paddle will provide you with invoices and receipts for all transactions. You can access your billing history through your Paddle account or by contacting Paddle support.

9.5 Failed Payments

If a payment fails, we may:

  • Retry the payment using the payment method on file
  • Send you a notification requesting updated payment information
  • Suspend access to paid features until payment is received
  • Terminate your subscription if payment remains outstanding

9.6 Taxes

All applicable taxes (including VAT, GST, or sales tax) are calculated and collected by Paddle based on your location. The prices displayed may or may not include taxes, depending on your jurisdiction.

10. Refunds and Cancellations

10.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of the current paid billing period
  • You will not be charged for subsequent billing periods
  • No refunds will be issued for the remaining time in your current billing period

10.2 Refund Policy

We generally do not offer refunds for subscription fees already paid. However, we may consider refund requests on a case-by-case basis for:

  • Technical issues that prevented you from using the service
  • Billing errors or duplicate charges
  • Other exceptional circumstances

To request a refund, contact us at hallo@andworks.ch or contact Paddle directly. Any approved refunds may be reduced by third-party costs already incurred (such as payment processing fees or services already consumed).

10.3 Cooling-Off Period

If you are a consumer in the European Union, you may have statutory rights to withdraw from your purchase within 14 days. However, by using the service immediately after purchase, you acknowledge that you may lose this right of withdrawal. Please contact Paddle if you wish to exercise any statutory withdrawal rights.

10.4 Subscription Downgrades

If you downgrade from a paid plan to a lower tier or free plan, the change will take effect at the end of your current billing period. No refunds or credits will be issued for the difference in plan pricing.

10.5 Termination for Non-Payment

If your account has outstanding payments, we may:

  • Restrict access to paid features
  • Suspend your account until payment is received
  • Terminate your account if payment is not received within a reasonable time

11. Indemnification

You agree to indemnify, defend, and hold harmless andworks GmbH and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of FAVORO
  • Your violation of these Terms of Use
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you store in FAVORO that violates applicable laws
  • Your access to websites through bookmarks stored in FAVORO

12. Limitation of Liability

12.1 Service Provided "As Is"

FAVORO is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement

12.2 Liability Cap

To the maximum extent permitted by law, our total liability for any claims arising from your use of FAVORO shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or CHF 100, whichever is greater.

12.3 Exclusions

We are not liable for:

  • Loss of data (though we take reasonable precautions including twice-daily backups)
  • Indirect, incidental, or consequential damages
  • Lost profits or business opportunities
  • Damages from service interruptions
  • Content of third-party websites you bookmark
  • Actions taken by third-party websites you access through FAVORO

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

13. Regulatory Compliance

13.1 Your Compliance Obligations

You are responsible for ensuring that your use of FAVORO complies with all applicable laws and regulations in your jurisdiction, including:

  • Data protection and privacy laws
  • Consumer protection regulations
  • Export control laws
  • Any industry-specific regulations that may apply to you

13.2 Geographic Restrictions

FAVORO is operated from Switzerland and is designed to comply with Swiss and EU regulations. If you access the service from other jurisdictions, you do so at your own risk and are responsible for compliance with local laws.

14. Account Termination

14.1 By You

You may terminate your account at any time through the settings page. Upon termination:

  • Your bookmark data will be permanently deleted
  • This action cannot be undone

14.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Use
  • Engage in fraudulent or illegal activity
  • Fail to pay applicable fees (if any)

14.3 Effect of Termination

Upon termination, your right to use the service ends immediately, and we may delete your data.

15. Changes to These Terms

We may update these Terms from time to time. If we make significant changes:

  • We will notify you via email or in-app notification at least 30 days before changes take effect
  • Continued use after changes constitutes acceptance

We encourage you to review these Terms periodically.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict of law principles.

16.2 Jurisdiction

Any disputes shall be resolved in the courts of Baden, Canton of Aargau, Switzerland.

16.3 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at hallo@andworks.ch to attempt to resolve any dispute informally.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and andworks GmbH regarding FAVORO.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

17.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to any successor or affiliate.
